Terms of use

By downloading, accessing or using Mindless, you agree to these Terms. If you do not agree, do not use the app.

1. Who may use Mindless

You must be at least 13 years old to use Mindless. By using the app you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. What Mindless is

Mindless is a digital wellbeing app. It helps you block distracting apps, set daily time limits, record intentions, journal, and track your mood and sleep.

Mindless is not a medical device and does not provide medical, psychological or therapeutic advice, diagnosis or treatment. Its journaling, mood and sleep features are for personal reflection only.

3. Your account

You need an account to use Mindless. On iOS you sign in with Apple. On Android you sign in with Google.

You are responsible for keeping access to your account secure and for activity that takes place under it. Tell us at support@mindless.so if you believe your account has been accessed without your permission.

You may delete your account at any time in Settings, then Delete Account, or by following the instructions at mindless.so/delete-account. Deleting your account does not cancel your subscription, see section 6.

4. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Mindless on any device you own or control, for your own personal, non-commercial use, in accordance with these Terms and with the rules of the app store you obtained it from.

Mindless is licensed to you, not sold. We reserve all rights not expressly granted.

You may not:

• copy, modify, adapt or create derivative works of the app;
• reverse engineer, decompile or disassemble the app, except where such restriction is prohibited by law;
• rent, lease, lend, sell, sublicense or redistribute the app;
• remove or obscure any proprietary notices;
• use the app to break any law, or to interfere with or disrupt the service.

5. App blocking

Mindless blocks apps you have chosen to block, using the permissions you grant it. Blocking depends on your device's operating system and settings, and its reliability can vary between manufacturers and operating system versions. It can be bypassed by disabling the permissions Mindless relies on.

We do not guarantee that blocking will be effective in all circumstances, and we are not liable for any consequences of a block not being applied.

6. Subscriptions and billing

Mindless offers auto-renewing subscriptions. The price, billing period and any free-trial or introductory terms are shown to you before you purchase.

Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before it ends. Payment is charged to the account of the app store you purchased through.

To cancel:

• Google Play: Play Store, then Payments and subscriptions, then Subscriptions
• Apple App Store: Settings, then your name, then Subscriptions

Cancelling stops future renewals. You keep access until the end of the period you have already paid for.

Refunds are handled by the app store you purchased through, in accordance with its policies. We cannot issue refunds for purchases made through Google Play or the Apple App Store directly.

Deleting your Mindless account does not cancel your subscription. Cancel it through your app store, or billing may continue.

If we change the price of a subscription, we will give you notice and the opportunity to cancel before the change takes effect.

7. Your content

Your journal entries, intentions, check-ins and other content you create in Mindless remain yours.

You grant us a limited licence to store, process and transmit that content solely to operate the app and provide it back to you, including sending your journal entries to our AI provider so that responses can be generated. We do not use your content for advertising, and we do not sell it.

You are responsible for the content you create. Do not submit content that is unlawful or that infringes someone else's rights.

8. Focus Rooms and community features

Some Mindless features let you interact with other people, including Focus Rooms and unblock requests.

When using these features, do not harass, abuse, impersonate or threaten others, or share unlawful or infringing content. We may remove content or suspend access to these features if you do.

Anything you share in a shared space is visible to other members of that space. Do not share information there that you want to keep private.

9. Intellectual property

Mindless, its name, logo, design and all software and content we provide are owned by us or our licensors and are protected by intellectual property law. These Terms give you no rights in them other than the licence in section 4.

10. Suspension and termination

You may stop using Mindless at any time by deleting your account.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Where reasonable, we will give you notice. If we discontinue the service entirely, we will make reasonable efforts to notify you in advance.

11. Disclaimers

To the fullest extent permitted by law, Mindless is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements.

Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection law in your country.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Mindless.

Our total liability for any claim relating to Mindless will not exceed the amount you paid us in the twelve months before the claim.

13. Changes to these terms

We may update these Terms from time to time. If we make significant changes we will notify you in the app or by email. Continuing to use Mindless after the changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

If you are a citizen or resident of the European Union, the European Economic Area, Switzerland, Norway or Iceland, you have the benefit of any mandatory provisions of the law of your country of residence, and nothing in these Terms affects your rights as a consumer under that law.

15. Additional terms for the Apple App Store

This section applies only if you obtained Mindless from the Apple App Store.

• These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Mindless and its content.
• Your licence to use Mindless is limited to a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for Mindless.
• If Mindless fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Mindless.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to Mindless, including product liability claims, any claim that Mindless fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• We, not Apple, are responsible for investigating and resolving any third-party claim that Mindless infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Additional terms for Google Play

This section applies only if you obtained Mindless from Google Play. Your use of the app is also subject to the Google Play Terms of Service. These Terms are between you and us only, not with Google.
